HELPER TERMS OF SERVICE & INDEPENDENT CONTRACTOR AGREEMENT

These Terms apply to all independent service providers (“Helpers”) using the Mom List platform (“Platform”). By accessing or using the Platform as a Helper, you agree to the following: Mom List is a technology platform that connects you with customers (“Customers”) and does not provide services or employ, control, or supervise Helpers or Customers. You acknowledge that you are an independent contractor, not an employee, agent, or representative of Mom List. You retain full control over if, when, where, and how you perform services, may accept or decline any job, and use your own tools and methods. Nothing in this Agreement creates an employment relationship. You are solely responsible for your services, compliance with all applicable laws and licensing requirements, your conduct, and any resulting damages, injuries, or losses. You agree to maintain all required licenses, permits, and insurance. You agree to indemnify, defend, and hold harmless Mom List and its affiliates from any claims, damages, liabilities, or expenses arising from your services, including bodily injury, death, or property damage. You consent to identity verification; approval does not constitute employment or endorsement. You agree not to engage in illegal, unsafe, or harmful conduct, including harassment or misrepresentation. Violations may result in removal from the Platform. Mom List may facilitate payments; you are responsible for your own taxes and financial obligations. Mom List does not guarantee job availability, earnings, or customer selection. Mom List may suspend or terminate your access at any time for violations or safety concerns. You acknowledge that working as a Helper will involve going to customer’s homes which involves inherent risks, including property damage, personal injury, or misconduct, and you voluntarily assume all such risks. To the fullest extent permitted by law, Mom List is not liable for any damages, injuries, losses, theft, or misconduct arising from you providing services as a Helper. Any disputes shall be resolved through binding arbitration through the American Arbitration Association’s (“AAA”) commercial rules, except where prohibited by law. By using the Platform, you acknowledge that Mom List is not liable for your actions and that you are fully responsible for your services.

MOM TERMS OF SERVICE & CUSTOMER AGREEMENT

These Terms apply to all individuals seeking helpers (“Customers”) through using the Mom List platform (“Platform”). By accessing or using the Platform, you agree to the following: Mom List is a technology platform that connects you with independent service providers (“Helpers”) and does not provide services or employ, control, or supervise Helpers. Helpers are independent contractors, not employees, agents, or representatives of Mom List. You are solely responsible for selecting a Helper, determining their suitability, providing accurate job details, and maintaining a safe environment for services, including disclosing any known hazards. You acknowledge that engaging Helpers and allowing them into your home involves inherent risks, including property damage, personal injury, or misconduct, and you voluntarily assume all such risks. To the fullest extent permitted by law, Mom List is not liable for any damages, injuries, losses, theft, or misconduct arising from services performed by Helpers. You agree to indemnify and hold harmless Mom List from any claims, damages, or disputes arising from your use of the Platform or interactions with Helpers. Mom List’s total liability, if any, shall not exceed the amount you paid for the service giving rise to the claim. Mom List may perform screenings but does not guarantee the accuracy, behavior, or reliability of any Helper. You consent to identity verification; approval does not constitute endorsement. You agree not to engage in illegal, harmful, or unsafe behavior, including harassment or requesting unlawful services. Violations may result in removal from the Platform. Mom List may facilitate payments and charge a platform fee but is not responsible for disputes regarding service quality or outcomes and does not guarantee service availability or results. Mom List may suspend or terminate your access at any time for violations or safety concerns. Any disputes shall be resolved through binding arbitration through the American Arbitration Association’s (“AAA”) consumer rules, except where prohibited by law. By using the Platform, you acknowledge that Mom List is not the service provider, Helpers are independent contractors, and you assume all risks associated with using the Platform.
